The aging-out problem, in plain language

Under many family and employment-based immigrant petitions, unmarried children can be included as derivatives only while they remain under 21 (with limited statutory protections). The Child Status Protection Act (CSPA) can, in some cases, preserve a child's age for immigration purposes, but CSPA formulas are fact-specific and depend on petition type, filing and approval dates, and visa availability. This page does not calculate CSPA age for any child. If a dependent is approaching 21 while a parent's case is still waiting for a visa number, families often look for paths that can lock in derivative status earlier or on a different category timeline. EB-5 is one option some households evaluate because the child can be included as a derivative on the investor's petition when eligibility rules are met. Confirm your child's situation with an immigration attorney before relying on any strategy.

H-4 children and aging out

Children on H-4 status as dependents of an H-1B parent face a version of the same clock: their ability to stay in the U.S. as H-4s, and to remain derivatives on a parent's immigrant petition, is tied to age and to the parent's continuing status and green card case. When the parent's employment-based wait stretches, an H-4 child can age out of derivative eligibility even if the family has lived in the U.S. for years. Some H-1B households evaluate an EB-5 filing so a spouse and unmarried children under 21 can be included on the investor's petition as derivatives. SeeEB-5 for H-4 families & dependents. That structure still requires attorney review of CSPA and derivative eligibility for each child; it is not automatic protection against aging out.

Aging out and the India backlog

India's EB-2 and EB-3 employment-based categories have historically faced significant demand under per-country limits. Longer queues mean more calendar time between a parent's early petition steps and the moment a visa number becomes available, and that calendar time is exactly what interacts with a child's age. Indian families therefore encounter aging-out pressure more often and more acutely than families from most other countries of birth, even when the parent's case is otherwise strong. Exact wait times change; use theVisa Bulletin and an attorney for current category movement. India-focused pathway context:EB-5 for Indian investors andEB-5 for Indian H-1B professionals.
