H-4 status and work authorization uncertainty

H-4 dependents are tied to the principal H-1B holder's status. H-4 EAD eligibility has been subject to policy challenges and processing variability, which leaves some spouses without reliable work authorization even when the household is otherwise stable. That uncertainty is one reason some families evaluate a self-sponsored green card path that does not depend on H-4 EAD rules remaining unchanged.

How spouses and children can be included

When a qualifying principal investor files an EB-5 petition, a spouse and unmarried children under 21 can typically be included as derivative beneficiaries, subject to age-out and CSPA considerations that must be reviewed for each child. Derivative status does not create a separate investment requirement for each family member, but documentation, ages, and filing timing still matter. Families concerned about children approaching 21 should discuss CSPA timing with counsel before assuming coverage. For the H-1B principal's pathway framing, seeH-1B to green card via EB-5.

What EB-5 does (and does not) change overnight

EB-5 is a separate petition process. It does not instantly convert H-4 status into permanent residence, and it does not guarantee work authorization on a fixed calendar. Concurrent filing, where available, may allow some applicants to seek an EAD while the case is pending. Eligibility depends on status, category availability, and attorney review. For process mechanics, use the EB-5 investment process guide.
