The EB-5 Immigrant Investor Program gives eligible foreign nationals a path to a U.S. green card through a qualifying investment. Investment requirements
EB-5 requires a qualifying investment in a new commercial enterprise, structured to create the required number of U.S. jobs. Visa category and timing: what "country of birth" means for Indian investors
EB-5 visa numbers are allocated by country of birth (chargeability), not current citizenship or residence. The filing process, in brief
- Select a project and complete source-of-funds documentation
- File Form I-526E (with concurrent adjustment of status filing for investors already in the U.S. on a valid nonimmigrant status, or consular processing for investors abroad)
- Receive work authorization and travel document during the concurrent filing period, where applicable
- Await visa number availability and I-526E adjudication
- File Form I-829 to remove conditions on permanent residence
