The two paths after graduation
The Traditional Path
F-1 → Graduation → OPT / STEM OPT → H-1B lottery → Employment-based green card queue (historically long waits for many Indian-born applicants in EB-2/EB-3)
The EB-5 Path
F-1 → EB-5 investment and I-526E filing → Concurrent filing for work authorization and travel document → Potential self-sponsored green card, independent of employer or lottery outcome
EB-5 does not automatically or immediately convert F-1 status into a green card. Filing an EB-5 petition is a separate immigration process with its own eligibility, documentation, and timeline requirements. This comparison is educational. Talk with a qualified immigration attorney about your specific situation.
Why Indian F-1 students look at EB-5
Indian students on F-1 status face two separate sources of uncertainty after graduation: the H-1B lottery, which is not guaranteed, and employment-based green card categories, where India-chargeable EB-2 and EB-3 cases have historically faced significant backlogs. Exact wait times change and should be checked against the currentVisa Bulletin, not assumed from older figures. EB-5 is structured differently. It does not depend on lottery selection or on an employer's willingness to sponsor a petition. For students whose families have the financial capacity to consider it, some begin evaluating EB-5 while still in school, which allows more time to document source of funds and select a project before OPT or STEM OPT authorization ends. For the broader student pathway overview, seeF-1 to EB-5 self-sponsored green card.
How parental funding usually works
Many Indian F-1 students are not the source of investment capital themselves. A parent or family member often provides the funds, typically as a documented gift. USCIS requires a clear, lawful paper trail for any funds used in an EB-5 investment, regardless of who originally earned them. Families remitting capital from India also need to plan around RBI and Liberalised Remittance Scheme (LRS) compliance with a qualified adviser. See our full guide onhow Indian families can fund an EB-5 investment.
Timing considerations
EB-5 program rules and filing windows change. Students evaluating this path should confirm current deadlines, investment thresholds, and visa category rules before making a decision. See ourGrandfathering Deadline tool andcurrent EB-5 guide for the latest information. Country-specific STEM OPT timing risks are covered inEB-5 for Indian and Chinese students on F-1 and STEM OPT.
