In many EB-5 cases involving Indian international students or young professionals, the child is the investor of record, but a parent or other family member is the actual source of the funds. This is a normal and accepted structure in EB-5. USCIS does not require the investor to have personally earned the investment capital. What USCIS does require is a clear, documented, lawful trail showing where the money came from and how it reached the investor. How the gift structure typically works
- Establish the gift relationship. A parent (or other family member) formally gifts funds to the student investor, documented with a signed gift letter or deed of gift.
- Document the parent's source of funds. USCIS looks through to the original source of the gifted funds, not just the gift itself. This can include income records, business ownership documentation, property sale records, or other lawful sources going back multiple years.
- Trace the path of funds. Bank records showing the money moving from the parent's account to the student's account, and then to the new commercial enterprise or regional center escrow account, need to form a complete, unbroken paper trail.
- Plan for LRS and RBI compliance. India's Liberalised Remittance Scheme (LRS) governs how individuals can remit funds abroad, and Reserve Bank of India (RBI) rules affect how investment capital can leave India.
