India chargeability and why EB-5 enters the conversation
Many Indian H-1B professionals eventually reach an employment-based green card petition (typically EB-2 or EB-3) only to find that India-chargeable demand has historically produced long queues under per-country limits. Exact wait times change and should be checked against the currentVisa Bulletin; this page does not cite specific multi-year estimates that go stale. EB-5 uses a different visa allocation structure, including reserved categories that some Indian professionals evaluate as a parallel track. EB-5 still has its own rules, capital requirements, and category dynamics. It is not a guaranteed faster outcome. For shared H-1B concurrent-filing and employer-independence mechanics (without repeating them here), seeH-1B to green card via EB-5.
A separate process from your H-1B employer petition
Once an EB-5 petition is filed, it does not depend on H-1B lottery selection, PERM sponsorship, or continued employer willingness to pursue an employment-based case. That separation is why some Indian professionals treat EB-5 as a backup or primary track while remaining on H-1B. IT staffing and consulting H-1B holders
A large segment of Indian H-1B professionals work through IT staffing or consulting arrangements rather than as direct hires of the end client. Those arrangements can add layers of uncertainty: project placement, vendor contracts, and sponsorship that sits with the consulting employer rather than the worksite company. EB-5's employer-independence applies the same way regardless of consulting versus direct-hire status: the green card case stands on the investor's qualifying investment and petition, not on who signs the H-1B or who staffs the project. Individual eligibility and timing still need attorney review.
