Build Your Career in the USA
    Without the H-1B Lottery.

The EB-5 green card gives international students in-state tuition, unrestricted employment, and permanent residency, all without a sponsor.

    Market Update, April 2026

The Filing Window for International Students Is Open NOW

EB-5 reserved categories are current on the most recent Visa Bulletin. International students on F-1/OPT can file I-526E and I-485 concurrently and bypass the H-1B lottery entirely. Petitions filed before September 30, 2026 are grandfathered under current provisions. After that date, these protections disappear.

    The Tuition ROI: Save $80,000–$160,000

EB-5 green card holders qualify as domestic students at public universities. The difference in tuition between international and in-state rates is staggering.

    $20K–$40K

Saved per year on tuition at a public university

    $80K–$160K

Total savings over a 4-year degree

    Up to 50%

Of the EB-5 investment cost offset by tuition savings alone

Pro Tip: The savings on a 4-year degree at a public university can pay for nearly half of the $800,000 EB-5 investment. When you factor in tuition ROI, the true net cost of a green card drops dramatically.

    The Hiring Advantage

Many top employers won't interview F-1 students because of the cost and risk of H-1B sponsorship. A green card eliminates that barrier entirely.

    As an F-1 Student

    • Limited to employers willing to sponsor H-1B
    • Many job postings explicitly exclude visa candidates
    • OPT/CPT work restrictions and time limits
    • Must leave the country if H-1B lottery fails

    With an EB-5 Green Card

    • Apply to any employer — no sponsorship needed
    • Equal standing with U.S. citizens in hiring
    • Start your own business or freelance freely
    • Never worry about visa status or deportation

The Gifted Funds Path for Families

For most international students, the $800,000 investment comes as a gift from parents or family members. This is fully permitted under EB-5 regulations — but requires meticulous documentation.

Parents in India or elsewhere must demonstrate the lawful source of their funds through business records, property sales, tax returns, and bank statements going back 5–7 years. A formal gift letter and wire transfer documentation complete the paper trail.

This process typically takes 1–3 months and should be started well before the EB-5 filing deadline. Working with an experienced immigration attorney who understands international source-of-funds documentation is critical.

    The Student EB-5 Timeline

When to file to ensure you never have to leave the country after graduation.

    1

Phase 1 — Year 1–2 of studies or during OPT

    During Your Degree (or OPT)

Begin source-of-funds documentation and family financial planning. Consult with an EB-5 attorney to evaluate your eligibility.

    2

Phase 2 — Ideally before OPT expiration

    File I-526E Petition

Select a qualified EB-5 project, invest the $800,000 minimum, and file your I-526E petition with USCIS.

    3

    Phase 3 — 3–6 months after filing

    Concurrent Filing (I-485)

File for Adjustment of Status simultaneously. Receive your EAD (work permit) and Advance Parole (travel permit) within months.

    4

    Phase 4 — 2–4 years total

    Green Card Approval

Once your I-526E is approved and a visa number is available, your green card is issued. No lottery, no sponsorship needed.

What Students and Families Are Saying

"Everyone in my program was obsessing over the H-1B lottery. I watched seniors with perfect GPAs and FAANG return offers get rejected three years in a row. My parents and I decided to file I-526E during my junior year. By the time I graduated, I had my EAD in hand. I walked into my first day at a top-tier tech company as a permanent resident while my classmates were still refreshing their lottery results. No sponsorship conversations, no cap-gap anxiety, nothing. It changed everything."

F-1 Student, Computer Science, University of Texas at Austin, EB-5 filed March 2025

"As a parent, the source-of-funds process was the part I was most worried about. We had savings across multiple accounts, some real estate, and a family business back home. The attorneys walked us through every document, every bank statement, every transfer. It took about two months to get the full paper trail together, but once it was done, the I-526E filing was straightforward. My daughter now has her green card and is starting medical school without any visa limitations. Worth every hour of paperwork."

Parent of F-1 Student, Gift of Funds, EB-5 filed January 2025

"I was on OPT with about 14 months left before I'd need to either win the H-1B lottery or leave the country. Filed I-526E and I-485 concurrently through a rural TEA project. Got my EAD combo card five months later, two months before my OPT was set to expire. I didn't even enter the H-1B lottery. My employer was relieved, I was relieved, and now I'm building my career on my own terms. If you're on OPT and have the resources, stop waiting."
