EB-5 vs. other U.S. visa categories
E-2 (treaty investor)
Nonimmigrant treaty-investor status. Generally requires nationality of a treaty country, an investment in a U.S. business, and ongoing E-2 compliance. It is not itself a direct green card path. EB-5, by contrast, is an immigrant category aimed at permanent residence through a qualifying EB-5 investment structure. Different legal framework, different petition forms, and different outcome (immigrant vs. temporary treaty status).
L-1 (intracompany transfer)
Employer-dependent nonimmigrant status for qualifying intracompany transferees. Time-limited and tied to the petitioning employer relationship. EB-5 does not require that same continuing employer transfer eligibility; it is an investment-based immigrant petition. L-1 holders sometimes evaluate EB-5 as a permanent alternative. O-1 (extraordinary ability)
Nonimmigrant category for individuals who meet a high, specific evidentiary bar for extraordinary ability in defined fields. No EB-5-style capital investment is required, but the proof standard is demanding and distinct. EB-5 turns on investment, source of funds, and job creation rather than an O-1-style ability showing. Different eligibility theory entirely.

Those programs and U.S. EB-5 serve different goals: residency and physical-presence rules differ, paths to citizenship differ, and investment or selection structures differ.
