The company they are building may be the very entity that would need to sponsor them, which can create circular or fragile status arrangements, especially early when payroll, ownership, and control are still taking shape. Why investor-status independence matters

EB-5's structure is built around a qualifying investment and petition, not around continued employment by a third-party sponsor. For some founders, that independence is the point: immigration planning can proceed on a track that is not identical to the startup's financing rounds, board decisions, or ability to file an H-1B.
